Adjudication: one contract or two?
In
Lapp Industries Ltd v 1st Formations Ltd [2025] EWHC 943 (TCC) Adrian Williamson KC, sitting as a Deputy Judge of the High Court, held that an adjudicator did have
jurisdiction to make the decision which she had made and that she had not breached the principles of natural justice in reaching
that decision. In particular, he held that the defendant had not established that the parties had entered into more than one
contract such that the claimant was seeking to refer disputes arising under different contracts to a single adjudication.
Rather, this was a case where the scope of the work had increased as the project had developed but the work was all done under
a single contract.
