The Fisher Review

A reformation rather than an overhaul of the approach to disclosure in criminal proceedings in England and Wales

Jonathan Fisher KC (Fisher KC) was commissioned by the Home Secretary in October 2023 to conduct an independent review of Disclosure and Fraud Offences (the Fisher Review). The Fisher Review arose in response to the challenges involved in investigating large volumes of digital material and concerns regarding non-disclosure in recent miscarriages of justice including the 17-year imprisonment of Andrew Malkinson, whose conviction for rape was overturned following disclosure failings, and the high-profile Post-Office Horizon scandal.
