Enhanced pension lawful

A council officer’s enhanced pension as a result of a long service award was lawful on the condition that it reflected the officer’s continued worth as an employee, was made in order to attract staff, dissuade staff from leaving, and was discretionary. It should also be based on consideration of each case on its merits. Council’s appeal against decision of Pension Ombudsman was dismissed. Pension was reinstated, arrears and interest paid and £250 paid for distress and inconvenience.
