Negligence in dentistry

Bailey v Bijlani [2025] EWHC 175 (KB)

Dentistry was long known as a profession in which there is a high risk of wrong site surgery being carried out. Removal of the wrong tooth has been specifically excluded from the British Dental Association's definition of wrong site surgery as a "Never Event" since 2021, with claims for this and other forms of dental negligence seldom reaching the trial stage. However, the High Court has recently heard a dental negligence case which raised another interesting point concerning the use of a debit or credit card to pay for treatment.
