The claimants insured their home with Medical Insurance Society Ltd (MIS) from 13 August 2010. The policy provided that it would "compensate" for any loss or damage. Under the Earthquake Commission Act 1993 the The Toka Tū Ake Natural Hazards Commission (fka the Earthquake Commission (EQC)) paid the first NZ$100,000 of any natural catastrophe loss, and private insurance provided a top up.
