Costs in personal injury claims involving findings of fundamental dishonesty

Williams-Henry v Associated British Ports & Another (Re Wasted Costs Order) [2024] EWHC 2415 (KB)

There are a growing number of cases in which costs have become an issue in personal injury claims where fundamental dishonesty is alleged. In the case outlined below, the defendant applied for a wasted costs order (WCO) against the respondent firm of solicitors that acted for the claimant in such a personal injury claim, which was widely publicised in the legal press.
