Proof of negligence crucial

A claim for diminution of life expectancy, occasioned by a failure to diagnose, could only succeed where it was shown as a matter of probability that the loss was caused by the defendant’s negligence. Damages in a clinical negligence case could not be recovered where the lost chance of a better outcome was less than even.
