Where parties had furnished imprecise information, and a percentage order was practicable, a judge was not obliged to make an issue-based costs order. In this case of professional negligence, the plaintiff had been awarded more than the sum paid in to court but, failing on one issue which appeared to have been pursued when clearly inappropriate, was deprived of 25% of costs.
