Over-65s entitled to employment protection,
including claim of unfair dismissal or for redundancy pay according to EU law. In this case two men working in the clothing
industry were dismissed because they were over 65. Their specific case was also seen as indirect sexual discrimination as
far more men than women continue to work in the clothing industry above the age of 65 though with loss of rights such as redundancy
pay.
