Liability Risk and Insurance
Liability of reinsurer’s parent
The New York Supreme Court, in
British Ins Co v Lancer Ins Co
, will hear arguments that the corporate parent of an insolvent reinsurer should be liable for that portion of an arbitration
award the reinsurer was unable to honour. The hearing will hinge on whether the parent benefited from fraudulent conveyances
after the reinsurer learnt of substantial environmental claims.
