Tobacco update
10-year immunity period fixed to 1988–1997
by subsequent rescinder of the Act. This the ruling of the California Supreme Court that tobacco companies are not shielded
from product liability suits falling outside that period. The court held by majority, in
Myers v Philip Morris Cos
, that the repeal of the Immunity Statute ‘contains no express retroactivity provision’ and that outside that period the liability
of tobacco companies ‘is governed by general tort principles.’
