Proof of ‘practicability’

Under section 40 of the Health & Safety at Work Act, the onus was formerly on the accused to prove that compliance was not practicable. Now, taking account of the Human Rights Act, this has been reduced to the lighter burden to give sufficient evidence to raise the issue. This in a preliminary ruling by HH Judge Robertshaw.
