Claim against P&I Club - Anti-suit injunction - Declaratory relief
The container ship
X-Press Pearl sank off Sri Lanka on 2 June 2021. The vessel was insured against liability by the claimant P&I Club. The Club Rules contained
the usual provisions applicable to the insurance: English law was applicable; any claim had to be referred to arbitration
in London; the Club itself had the right to exercise subrogation rights in any fora to pursue or enforce its rights; and the
insurance was written on a "pay to be paid" basis.
