Ship finance - Mortgages - Bank claim following loan default- Security over vessels - Vessels sold by port authority in private sale - Duties of bank

The first to third defendants were one-ship companies, owned jointly by the fourth and sixth defendants. The claimant bank provided a financing facility of just over $12 million to the first to third defendants, for which they were jointly and severally liable. The loans were secured on the three vessels and payment was additionally secured by personal guarantees given by the fourth to sixth defendants.
