No doctrine of "deemed fulfilment" in ship sales

This case looks at the position where the buyers' breach of a condition precedent prevented payment of the vessel's deposits, and the question of whether the sellers are entitled to claim the deposits as a debt or whether its claim is limited to one in damages, and examines whether the doctrine of deemed fulfilment exists as a principle of English law.
