TUI UK Ltd v Griffiths [2023] UKSC 48

The Supreme Court has ruled, in the case outlined below, that in respect of expert evidence, the principle of fairness dictates that a party in civil proceedings should not hold back the entirety of its criticisms of the evidence of a particular expert until the closing submissions so that the expert in question has no opportunity to respond.
