DVT group litigation proceeds

The High Court has cleared the way for group litigation on the preliminary issue of whether deep vein thrombosis (DVT) is an ‘accident’ under the Warsaw Convention, although it is unlikely to be heard for at least a year. Previous judges have upheld the airlines’ arguments that DVT is not an accident caused by an event ‘external’ to the passenger.
