Functional or psychological ‘overlay’

Consideration has been given to a condition where a person claims to be suffering a physical injury but doctors are satisfied that the symptoms arise from a psychological state. In two cases at issue – because no psychological case had been put forward by the plaintiff – the appeal tribunal upheld an earlier finding that the disabilities complained of did not fall within the terms of the Disability Discrimination Act.
