Validity of legal aid certificate

The Legal Services Commission (LSC) has no power to prevent work under full legal aid certification prior to its discharge. In the personal injury case at issue, a £10,000 settlement was rejected against solicitor’s and counsel’s advice; the LSC withdrew funding just before trial which, however, led to an award of £15,000. The decision is only applicable to certificates issued before April 2000.
