Causation in clinical negligence claims
Pickering v Cambridge University Hospitals NHS Foundation Trust [2022] EWHC 1171 (QB); [2022] Med LR 344
It is well-known that many clinical negligence claims fail at the causation stage because of the complex nature of the evidence.
However, in the case outlined here, in which the defendant had conceded that there had been a breach of duty by the end of
day one of the High Court trial, it was possible for a causal link to be established between the breach of duty and the damage
sustained by the claimant.
