It is recognised that managing risks in psychiatry can be particularly difficult. However, there are many hurdles for patients and families who suffer tragic consequences to surmount if claims for negligence are to succeed. In the case outlined here, a patient and daughter both failed in their separate actions against the defendant NHS Trust.
