The claimant was the contractor on a construction project which included student accommodation and commercial units, practical completion of which was certified in 2009. The defendant was appointed as architect and its appointment included obligations to design, to co-ordinate the design of and inspect the works (there being a number of sub-designers, sub-consultants and sub-contractors engaged on the project). The owners of the site alleged that there were various defects in the works carried out and they issued a claim against the claimant in which they sought damages of approximately £12 million.
