Arbitration – Bills of lading – Claims "arising out of or in connection with" bill of lading – Issue estoppel – Estoppel by convention – Arbitration Act 1996, section 67

This was the claimants' appeal under section 67 of the Arbitration Act 1996 that certain counterclaims, brought before the tribunal by the claimants themselves, fell outside of the arbitration agreement. The claims concerned reasonable remuneration and quantum meruit and the decision under appeal was the tribunal's decision that they had arisen out of and in connection with the bill of lading at issue.
