Adult claims under the 1975 Act – Batstone v Batstone

Practitioners with experience in dealing with claims under the Inheritance (Provision for Family and Dependants) Act 1975 (the 1975 Act) will know that trials are uncommon. Due to the broad and unpredictable nature of the jurisdiction, these disputes are fraught with litigation risk, the corollary of which is that resolution is more often than not reached by way of compromise rather than judicial determination.
