Human rights thresholds in care homes

Milner v Barchester Healthcare Homes Ltd [2022] EWHC 539 (QB)

The judicial review case outlined above highlighted the vulnerability of elderly people and the risks they face of suffering serious illness and injuries. Shortly after the publication of the judgment in that case, the High Court ruled, in a strike out application, on whether care provided to a resident by a care home breached her rights under arts 2 and 3 of the European Convention on Human Rights.
