Issues with pre-paid funeral trusts
From time to time private client lawyers are called on to act in disputes about how dead bodies should be disposed of and
what form a funeral should take, but who pays for the funeral and by what mechanism is not usually something on which their
opinion is sought. However, the imminent regulation of the pre-paid funeral market is forcing all pre-paid funeral providers
to assess their practices, and in particular the manner in which performance of their obligations to customers are secured.
Where a trust has been used to secure such obligations or is to be used in a new scheme, specialist advice is essential.
