Charterparty – Breaches of charter by charterers – Damages – Vessel redelivered with excess bunkers – Charterers giving insufficient redelivery notices – Quantification of owners’ losses

The subject vessel was chartered by a fixture recap email dated 24 February 2017 which incorporated the terms of an amended NYPE 1946 form “for balance of period (min 9 Oct 2017 up to max 9 Dec 2017)”. The “balance of period” referred to the balance of the period for which the owners, as disponent owners, had the vessel on time charter from owners up the charterparty chain.
