Pursuit of hopeless case

While a solicitor or barrister owed a duty to the court to maintain appropriate levels of competence, this duty was not breached simply by pursuing an apparently hopeless case. The court’s jurisdiction to award costs personally against the practitioner should only be used where there was a serious dereliction of duty.
