Blame for delay

Where failure to issue a claim for personal injury within the three-year limitation period was in no way the fault of the plaintiff, a judge was not entitled to treat him as if he was responsible for the delay. Further, a judge was not entitled to dismiss the claim so as to punish the solicitor, against whom a negligence action could have been brought.
