A Local Authority v JB [2021] UKSC 52

Supreme Court rules on deprivation of liberty, consent and limited capacity. Although the case concerned a decision to be made by a person whose decision-making capacity was limited in the context of sexual relations, it is important because of its wider implications for medical decision-making involving people who lack capacity, deprivation of liberty and the correct approach to considering the best interests of individuals. In the event, the Supreme Court remitted the case to the judge at first instance.
