Planning decisions and human rights

In the first instance of UK law being declared incompatible with the Human Rights Act, the high court, in considering four test cases, has held that the right of the Environment Secretary to ‘call in’ planning applications breached the applicants’ right to a fair trial by an impartial tribunal. If upheld on appeal, corrective legislation will be required.
