Level of damages under HRA
Law Commission reports to the Lord Chancellor recommend that the levels of damages in cases brought under the Human Rights
Act should be of comparable level to the general run in courts in England and Wales, and Scotland. These are likely to be
significantly higher than those previously awarded in Strasbourg, where the average stood at £15,000.
