Demurrage – Fixture recap incorporating charterparty – Fixture recap also incorporating berth operator’s rules – Charterparty and berth operator’s rules providing for different regimes for commencement of laytime – Whether commencement of laytime governed by charterparty terms or by berth operator’s rules

In this arbitration the owners claimed US$109,495.83 demurrage which they said was incurred at the loading port, Davant, on the Mississippi. The charterers denied liability and said that laytime was saved and they were entitled to despatch of US$6,359.38.
