Davey and Another v Bailey and Others [2021] EWHC 445 (Ch)

The doctrine of so-called “deathbed gifts” (or, to give it its Roman Law name, donationes mortis cause, or “DMC”) is one of those equitable doctrines seen more often by law students than practitioners, and those rare reasoned cases where the doctrine is invoked are therefore of interest (given the potential potency of the rule to step around statutory formalities imposed on will-making and gifts of land).
