French patent litigationtypically follows a “one-pot” format: within the same proceedings, the judgeconcurrently rules on
patent validity, patent infringement and, in manyinstances, also determines the amount of damages. However, in the event where the patent is foundinvalid, the parties and the court will have devoted much time, effort andresources
on issues of infringement and damages, that eventually became moot.Hence the appealing possibility of staggered proceedings.
