Condor Fresh, the plaintiff, had commenced proceedings against Pacific International Lines, the defendant, for damages totalling $255,580.11 for alleged breaches of a series of contracts of carriage for containerised goods and for alleged breaches of the Australian Consumer Law. It now sought leave pursuant to rule 10.43 of the Federal Court Rules 2011 (Cth) to serve the proceedings on the defendant in Singapore.
