Liability for injuries sustained on public path in local authority park

Barlow v Wigan Metropolitan Borough Council [2020] EWCA Civ 696

The Court of Appeal considered a case in which a claimant had suffered injuries as a result of tripping on a public path in a local authority-owned park. The main issue was whether the claimant had a cause of action for breach of statutory duty under the Highways Act 1980 s41.
