In response to a claim by Bank St Petersburg PJSC ("the Bank") under personal guarantees and a loan, Dr Arkhangelsky, together with his wife and their company, ("the appellants") counterclaimed against the Bank and its chairman, the second claimant, Mr Savelyev, ("the respondents") for damages in respect of an alleged conspiracy unlawfully to seize assets in Russia contrary to article 1064 of the Russian Civil Code ("article 1064").
