Liability of surveyor in connection with recently rebuilt property

In Hart v Large [2020] EWHC 985 (TCC) Mr Roger ter Haar QC, sitting as a Deputy High Court Judge, held that the defendant surveyor had been negligent when carrying out a homebuyer’s report on a recently rebuilt property. He gave particular content to the duty of a surveyor when surveying a recently rebuilt property and concluded that the defendant had been negligent in failing to draw to the attention of the claimants the need to obtain a Professional Consultant’s Certificate to give them protection in the event of there being defects in the property. He held that the defendant was liable for the difference between the value of the property without defects and the property as it was with all the defects which in fact existed.
