[2020] CSOH 7, Court of Session Outer House, Lady Carmichael, 15 January 2020
Environmental protest – Order prohibiting defendants from carrying out protest on board North Sea installation – United Nations Convention on the Law of the Sea, article 60(4) and (5) – Scots law
The pursuer, Shell, sought to interdict the defenders by themselves or by their agents, employers, volunteers or servants
from approaching within 500 metres of or boarding or attempting to board the four offshore installations Brent Alpha, Brent
Bravo, Brent Charlie and Brent Delta. These were at various stages of operation and decommissioning. Two Greenpeace protesters
had boarded Alpha without permission for 24 hours on 14 October 2019 in order to protest against the proposed method of decommissioning
the platforms.
