Motor insurance: use of motor vehicle

Under the Consolidated Motor Insurance Directive, European Parliament and Council Directive 2009/103/EC, member states are required to take all appropriate measures to ensure that civil liability in respect of the use of vehicles is covered by insurance. BTA Baltic Insurance Co AS v Baltijas Apdrošināšanas Nams AS Case C-648/17 raised the question of whether a vehicle can be regarded as being in use by a passenger.
