Warner v Scapa Flow Charters [2018] UKSC 52

Suspension or interruption of limitation periodThis case, originating from the Scottish courts, concerned the application of the time bar provisions in the Athens Convention relating to the Carriage of Passengers and their Luggage by Sea 1974.

Mr Warner had chartered a vessel operated by the defendant for the week 11 to 18 August 2012 for the purpose of diving. On 14 August 2012 he died during a dive. The claimants were his widow and their son, born in November 2011.
