Availability of judicial review and employment tribunal proceedings

Michalak v General Medical Council [2017] UKSC 71

The Supreme Court has held that the fact that judicial review proceedings in respect of decisions or actions of the General Medical Council (GMC) were available to a doctor did not exclude the jurisdiction of the employment tribunal under the Equality Act 2010 s120(7). Judicial review of GMC decisions was held not to constitute proceedings in the nature of an appeal, nor a remedy provided by reason of an enactment.
