Challenge to use of force by immigration officers

Shittu v Home Office [2017] EWCA Civ 1748

The Court of Appeal, in dismissing a claim for damages for battery, held that a judge had been entitled to find that immigration officers had used lawful and reasonable force when they attended the home of a family subject to removal directions. However, the court did not give guidance on the level of force appropriate to separate an adult from a child to facilitate removal in circumstances when there was no perceived risk of imminent harm to the child.
