Motor insurance: claims by persons injured abroad
In Howe v Motor Insurersâ Bureau [2016] Lloydâs Rep IR 359 Stewart J discussed a series of issues of law and procedure relating to an English claimant injured in a motor accident in France by an unidentified driver driving an untraced vehicle. Soon afterwards the Supreme Court reached its decision in Moreno v Motor Insurersâ Bureau [2016] Lloydâs Rep IR 99, which affected a significant part of the reasoning in Howe.
Since
Moreno,
Howe has been back to the Court of Appeal on two issues, both of some significance for the motor insurance regime:
Howe v Motor Insurers’ Bureau [2017] EWCA Civ 302 and
Howe v Motor Insurers Bureau (No 2) [2017] EWCA Civ 932.
