Burton v Evitt [2011] EWCA Civ 1378

This was an appeal against a decision of a trial judge, that he (E), had been negligent and was one-third responsible for a road traffic accident involving himself and B, the respondent in the appeal. E had been driving a car in front of a queue of traffic. When he slowed down and checked in his mirror, he observed nothing except a larger vehicle behind him, so he started to turn right at a slow speed into a car park.
