This Court of Appeal decision has raised some controversy. Some landlords welcome it and consider it will restrict the scope for abuse, but insolvency practitioners consider that it may hinder restructuring where a company voluntary arrangement is proposed, or possibly a pre-pack sale of the business or parts of it.
