This case raised a novel point which had not previously been decided or considered, even though the Landlord and Tenant Act
1954 was enacted just over 60 years ago. It concerned a request by a subtenant for a new tenancy where the superior lease
had been determined prior to the contractual expiry date of the subtenancy.
