Actions against brokers

BP plc v Aon Ltd [2005] EWHC 2554 (Comm), forthcoming in [2006] Lloyd’s Rep IR, raised issues as to the jurisdiction of the English court to join a broker to English proceedings, whether England was the most appropriate forum for the hearing of the dispute in the light of a non-exclusive jurisdiction clause in favour of another jurisdiction and whether a foreign limitation period independently barred the action.
