Contribution claims

Two short but important points on the application of the Brussels Convention 1968 was referred to the European Court of Justice for a preliminary ruling by the French Cour de Cassation in Groupement d’Interet Economique Reunion Europeenne v Zurich Espana and Soptrans (Case C-77/04), May 2005, forthcoming in [2005] Lloyd’s Rep IR. The ECJ concluded that a contribution claim is not one subject to the special jurisdiction rules applicable to matters relating to insurance but rather falls within the general provisions of the Convention.
